Even though the Constitutional Court has an “eight-member system” in place, a judge’s position remains vacant, prompting a call for a swift appointment.
Additionally, the court announced that it would quickly review the constitutional complaint filed against Acting President Choi Sang-mok for not appointing a constitutional judge, arguing that this is inappropriate.

With the new constitutional justices Jung Gye-seon and Cho Han-chang beginning their six-year terms on the first day of the new year, the Constitutional Court managed to establish an “eight-member system” after about two months.
However, with Acting President Choi Sang-mok holding off on the appointment of nominee Ma Eun-hyeok, one position still remains vacant.
The justices emphasized completing the bench not only during the commencement ceremony but also in general operations.
**[Moon Hyung-bae / Acting Chief Justice of the Constitutional Court]**: “We aim to enhance the collaboration among the full nine-member bench, the research unit focusing on selection and concentration, and the administrative office, forming a trinity.”
Even during the inauguration ceremony, the completion of the bench was a highlighted issue.
**[Jung Gye-seon / New Constitutional Judge]**: “I was prepared to give my third inauguration speech today, expecting the vacancy to be filled soon.”
The Constitutional Court also decided to quickly review the constitutional complaint related to the non-exercise of the judge appointment rights.
This complaint argues that not appointing a judge infringes on the right to a fair constitutional trial and is therefore unconstitutional. It was passed on to the full bench for a thorough review just three days after its filing.
**[Cheon Jae-hyun / Public Relations Officer of the Constitutional Court]**: “It was referred to the full bench on December 31 (last year). Taking the nature of the case into account, we plan to review it promptly.”
The enthusiasm to return to a “complete” state and accelerate trial proceedings is evident.
The Constitutional Court also mentioned that it would start reviewing the legality, including the legal requirements, of the case involving President Yoon’s office contesting the court’s issuance of an arrest warrant and filing for a power dispute adjudication and an injunction to suspend the warrant, as soon as the assignment procedures are completed.
