“Undercover Investigations for Digital Sex Crimes Against Adults” Bill Passes National Assembly

The amendment to the Special Act on the Punishment of Sexual Violence Crimes, which allows the police to conduct undercover investigations into digital sex crimes such as deepfake not only targeting children and adolescents but also adults, has passed the National Assembly.

The amendment permits the police to conduct undercover investigations where they can conceal their identities to access crime scenes, collect evidence and materials related to digital sex crimes, and use fake identities if necessary.

Additionally, it stipulates that if illegal acts are committed for unavoidable reasons during identity-concealed investigations, the police will not be subject to criminal punishment, disciplinary action, or liability for damages unless there is intent or gross negligence.

Alongside this, an amendment to the Information and Communications Network Act was also passed in the plenary session, allowing the Korea Communications Commission to order telecom service providers to suspend the posting of edited, synthesized, processed materials, and child and adolescent sexual exploitation materials.
