Some members of the Democratic Party advocate for a “four-level court system”… “No discussion at the party level.”

The Democratic Party has stated that it is not discussing the ‘Appeal Review’ system, which is being mentioned by some within the ruling party as a means of pressuring Chief Justice Cho Hee-dae. Democratic Party spokesperson Kim Hyun-jung told reporters today (30th) after an internal meeting that the ‘Appeal Review’ has not been officially confirmed or discussed at the party level.

The ‘Appeal Review’ is a system that allows constitutional reviews of cases that have already been finalized by the Supreme Court, which the court strongly opposes, citing it as essentially a “fourth-tier” review system. Spokesperson Kim explained that the mention of this idea seemed to expand from comments made by a lawmaker during a YouTube broadcast.

Previously, Democratic Party lawmaker Kim Seung-won suggested on the ‘Kim Eo-jun’s Humility is Hard News Factory’ show that if the judiciary does not make proper self-corrective efforts, the legislative branch could consider implementing the ‘Appeal Review’ system. He added that calling the Chief Justice to a hearing was intended to give the judiciary an opportunity to explain, and that if there is no response, introducing the appeal system would allow such cases to be judged by the Constitutional Court.

Furthermore, Kim suggested that allowing the Constitutional Court to cancel or deem such cases unconstitutional would place it above the Supreme Court, a prospect the latter would disfavor.
