“‘Drug Use Admitted’… ‘High School Rapper 2’ Contestant Yoon Byung-ho, Who Used Drugs Again in Detention Center, Appeal Dismissed”

Rapper Yoon Byung-ho (stage name Bully Da Bastard), who became known after appearing on ‘High School Rapper 2’ and was subsequently arrested on drug charges, appealed his sentence but the appeal was dismissed.

On the 18th, the 3-1 Criminal Division of the Suwon District Court (Presiding Judges Jang Jun-hyun, Jo Soon-pyo, Kim Eun-kyu) sentenced Yoon Byung-ho, who was indicted for violating the Narcotics Control Act (Psychotropic Substances), to the same sentence as the original trial: eight months in prison with a two-year suspended sentence. Additionally, Yoon was ordered to attend 40 hours of lectures on preventing drug-related crimes.

Previously, Yoon’s defense argued that “the testimony from witnesses who claimed to have seen drug use by snorting powder, known as ‘corking’, while Yoon was detained was inconsistent and unreliable.”

Furthermore, the defense claimed, “The investigation report states that drugs were detected in the defendant’s urine, but the urinalysis report shows they were not detected, indicating that the prosecutor’s evidence is insufficient,” leading to the appeal.

However, the appellate court did not accept Yoon’s claims.

The appellate court ruled, “It is recognized that drugs were used through the method of ‘corking’ while detained in Incheon Detention Center. The original judgment of guilt is justified.”

In August 2022, Yoon was prosecuted for using psychoactive substances containing diazepam, lorazepam, and zolpidem at the Incheon Detention Center in Michuhol-gu.

Yoon was initially sentenced to four years in prison in the first trial for charges including purchasing drugs via SNS from 2018 to July of the same year and using them with an acquaintance at his residence in Gyeyang-gu, Incheon.

For a separate case of buying drugs between November 2019 and April 2020, he was additionally sentenced to two years and six months in prison.

In the merged appeal trial for both cases, the court, in August 2023, sentenced him to seven years in prison and ordered him to complete a 40-hour drug addiction rehabilitation program. Yoon appealed the appellate court’s decision, but the Supreme Court upheld the original ruling.
