The Prosecutor General stated, “The directive to release President Yoon was made according to my conviction and does not constitute grounds for impeachment.”

Prosecutor General Sim Woo-jeong stated that the decision not to immediately appeal the court’s cancellation of President Yoon Seok-youl’s detention was made according to due process and was not grounds for impeachment. On his way to work today (the 10th), Sim told reporters that the investigation team’s opinions were gathered, including a meeting with the chief of the Supreme Prosecutors’ Office, and that he made a decision based on all the compiled opinions.

He emphasized that his decision was made according to lawful procedures and principles, and he did not believe it justified resignation or impeachment. However, he added that since impeachment is under the authority of the National Assembly, he would respond accordingly if the process proceeded.

Sim highlighted that ensuring due process and human rights guarantees has been a fundamental mission of the prosecution since his inauguration. He explained that decisions regarding the custody of defendants post-indictment are for the court to make, and that he respected the court’s decision.

Furthermore, he acknowledged that the court found long-standing issues with the practical conventions of the courts and prosecution regarding the calculation of detention periods. He also noted that even if such issues were absent, legal ambiguities should not cast doubt on the legality of investigation processes and procedures.

Additionally, Sim countered criticism regarding the delay in prosecuting President Yoon following the court’s denial of an extension to the detention period before indictment. He explained that a meeting of chief prosecutors was convened to thoroughly discuss the direction of handling national critical issues and legal points. He disagreed with claims that this meeting led to the court’s decision to cancel the detention.
