“Leader of Rebellion” Allegation: Yoon’s Side Files for Cancellation of Arrest with Court

President Yoon’s legal team, who is being detained on charges of masterminding a rebellion, has filed a request with the court to cancel his detention.

On the 4th, they submitted the request for cancellation of detention to the Criminal Division 25 of the Seoul Central District Court, presided over by Judge Ji Gui-yeon.

According to Article 93 of the Criminal Procedure Act, if the reasons for detention no longer exist, the court may cancel the detention either ex officio or upon request by the prosecutor, the defendant, or the defense counsel.

Unless there are special circumstances, the court must decide on the cancellation of President Yoon’s detention within seven days from the receipt of the request.

Some believe that the request for cancellation of President Yoon’s detention is unusual, as typically, detained suspects apply for bail. There is speculation that if the cancellation request is denied, his legal team might then apply for bail.

Bail is a system that releases a defendant under certain conditions, such as paying a security deposit. Even if bail is granted, the defendant’s residence may be restricted.
