Jeon Hyun-hee, the head of the Democratic Party’s Special Committee for the Three Major Special Prosecutions, stated that they will consider not only a court dedicated to trials related to insurrections but also the establishment of a ‘National Policy Manipulation Court’ to handle cases under investigation by the special prosecutions concerning Kim Gun-hee and Chae Hae-byeong. In a statement at the special committee meeting held at the National Assembly on the 15th, Chairman Jeon expressed intentions to gather party opinions and actively pursue the establishment of the National Policy Manipulation Court.
Jeon emphasized that a court dedicated to insurrection is not unconstitutional. She explained that it is legally feasible under Article 103 of the Constitution, ensuring that judges can decide cases according to the Constitution and the law, thus eliminating constitutional wrongdoings. She mentioned, “The establishment of a new court through the revision of the Court Organization Act is constitutionally possible,” clarifying that these dedicated courts would only address factual trials in the first and second instances, while maintaining the Supreme Court’s appellate review system.
Furthermore, Jeon argued that the judicial independence proclaimed by the Constitution is subordinate to the value of people’s sovereignty, as stated in Article 1 of the Constitution. She reiterated that the demand for creating a court dedicated to insurrection reflects the public’s disappointment with the judiciary’s perceived lack of fairness. She criticized the judiciary’s claims of unconstitutionality regarding the establishment of specialized courts, accusing them of political interference and questioning whether it is the judiciary itself that is undermining its independence.
