President Yoon Suk-yeol’s side emphasized that the potential involvement of the police riot squad in executing an arrest warrant by the Corruption Investigation Office for High-ranking Officials (CIO) is an illegal act without legal basis. Attorney Yoon Gap-geun, representing President Yoon, argued that the CIO law does not stipulate investigative command authority over the police. Therefore, if the police proceed with arrest and search warrant execution, it would be an unlawful act without legal grounds. He further noted that the police riot squad can only maintain public order and conduct security activities in the absence of investigative commands, and that warrant execution should be carried out directly by the prosecutors and investigators of the CIO. He warned that if the police riot squad goes beyond maintaining order to execute arrest or search warrants, they could be arrested by security personnel or citizens as current offenders of abuse of power and obstruction of official duties.
President Yoon’s side states that “It is illegal for the police mobile unit to execute a warrant.”
