“Compensation for ‘Force Majeure Childbirth Medical Accidents’ to be increased up to 300 million won.”

The Ministry of Health and Welfare has announced a draft amendment to the Enforcement Decree of the Medical Malpractice Compensation and Medical Dispute Mediation Act. This amendment aims to strengthen state responsibility for medical accidents that inevitably occur during childbirth.

The compensation limit, paid from state funds for unavoidable medical accidents during childbirth, will be raised from a maximum of 30 million won to 300 million won. The Minister of Welfare will also be required to form a compensation review committee.

In addition, to activate a simplified mediation system for victims to receive quick relief, the scope of related minor cases will be expanded from the current 5 million won to 10 million won.

Unavoidable medical accidents during childbirth refer to cases where, despite the medical staff fulfilling their duty of care, medical accidents occur related to childbirth, such as the death of the mother or newborn or cerebral palsy disabilities in the newborn.

The legislative notice period for the proposed amendment to the Enforcement Decree and Rules of the Act is from today (the 24th) until December 3.
