Regarding the medical accident in which a woman in her 30s, patient A, died at W Hospital operated by Yang Jae-woong, a specialist in the Department of Psychiatry at Bucheon City, the hospital announced the investigation results stating that they adhered to the quarantine and maximum allowable duration of restraint.
According to an 11th report by Hankyoreh, based on the ‘Current Status and Investigation Results of the W Hospital Patient Death Incident’ obtained by the office of Seo Mi-hwa, a member of the Health and Welfare Committee in the National Assembly from the Democratic Party, Bucheon City mentioned in the report they submitted on the 9th that they confirmed the gradual implementation of restraint and isolation under the direction of a specialist in psychiatry, followed by continuous monitoring according to the documentation review results.

Bucheon City mentioned in the report the reasons for making such judgments based on the examination of medical records, nursing records, etc., that detailed medical procedures were recorded during the hospitalization period (May 10th to 27th), and among them, it was noted that acts such as administering sedatives and isolation measures were taken in accordance with the medical judgment of medical professionals, and the report also pointed out that administrative agencies cannot assess whether the medical measures based on the medical judgment of the medical professionals violated laws.
However, Bucheon City added, “During the implementation of the restraint from 0:30 to 2:20 on the day of her death on May 27th, vital sign checks were missed, and they instructed for staff training on restraint and isolation guidelines.”
Regarding the investigation results, Je Cheol-ung, a professor at Hanyang University School of Law, pointed out, “Whether or not they violated Article 75 (Prohibition of restraint, etc.) of the Mental Health and Welfare Act can be investigated by administrative authorities. The key point here is not just the time and observation, but whether the self-harm risk was significantly high at the time of restraint, whether it was significantly difficult to avoid self-harm risks other than restraint, and whether the prescription of sedatives was appropriate, but these aspects were not investigated.”
A day before her death on May 26th, A, who had been confined to an isolation room, complained of abdominal pain and pleaded to be let out, but instead, she suffered physical violence on her hands, feet, chest, etc. for two hours without receiving proper care. Later, when she began to vomit blood in a bloated state, she was released from restraint, but eventually died while abandoned in the isolation room.
