“Lee Jae-myung, the leader of the Democratic Party of Korea, appeared at the appellate court hearing for his case involving a violation of the Public Official Election Act. The appeals court requested the prosecution to specify which of Lee’s statements related to false information. The Seoul High Court’s Criminal Division 6-2 held the third trial date for the case today and essentially requested the indictment be amended to clarify whether only specific statements related to the late Kim Moon-ki, former head of planning at Seongnam Development Corporation, are included in the charges.
Previously, the prosecution indicted Lee for making allegedly false statements on four different broadcasting stations where he claimed not to know Kim. It was reported that the indictment does not specify the exact sentences considered false but instead presents selected excerpts from the entire conversation.
The court asked, ‘While the entire context can be used for review, is it correct to limit the indictment to specific false statements, and is it acceptable without amending the indictment?’ When the prosecution indicated that amending the indictment was unnecessary, the court clarified, ‘This is to clearly understand which parts need assessment. Even if the whole context is included, specify which phrases are deemed false.’”
